On February 18, 2021, Indiana Governor Eric Holcomb signed legislation (SB 1) limiting businesses’ civil liability for damages resulting from an individual’s COVID-19 exposure: 

  • On business premises; 
  • On the premises the business provides to others; or 
  • During an activity the business manages, organizes, or sponsors. 

However, businesses are liable when their actions or omissions are proven to be gross negligence or willful misconduct (including fraud and intentionally illegal acts). 

The law took effect on February 18, 2021 and expires December 31, 2024.
